Terms of use of the mobile application

“P-Spacer” mobile application (hereinafter – “Mobile App”) is an integral part of the service sales platform. By using this Mobile App, you undertake to follow its terms of use specified below and thereby confirm that you agree to be bound by them. A mobile Internet connection is necessary to use the Mobile App, so the Mobile App can use data, which is charged according to the rates of your mobile operator.

1. Application owner

The mobile app is owned by UAB SOFTRA (company code 302250087, head office address Verkiu 34B-502, LT-08221 Vilnius, tel. +370 673 34500, e-mail info@softra.lt, website www.softra.lt).

All legislation protected intellectual property and copyrights to the Mobile App, including, but not limited to, the source code of the Mobile App, are owned by UAB SOFTRA (hereinafter - the Owner). It is prohibited to alter, decompile, modify or create derivative works based upon the Mobile App, as well as copy it to other devices, distribute or use the data contained in it for other purposes.

The Mobile App Owner has the right to change any data, functionality and design of the Mobile App or related to it without prior notice.

The owner grants you the right (license) to use this application under the following terms of use only for the purpose of using the services provided by the Mobile App.

2. Personal data and its protection

The requirements for the collection, processing and storage of your personal data are established in these terms of use, the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal acts. By indicating your personal data in the Mobile App, you thereby agree that it shall be managed and processed for the purposes, means and procedure provided for in these rules and legal acts. In the case of payment for vehicle parking services the Owner of the Mobile App collects and processes the following information about you: phone number, vehicle license plate number, paid service sum, paid service period, zone, parking lot, parking start and finish time. In the case of selection of the method of payment for services by deducting payments from the payment card account, the Owner of the Mobile App collects data about the purchaser’s name, family name and payment card. Also, the Mobile App is allowed to spot your location using the Global Positioning System. All the data listed above are collected to ensure the proper operation of the Mobile App, ordering of services, payment for services and to fulfil other contractual obligations. In order to ensure these goals, the Owner may transfer personal data to third parties in accordance with the procedure specified in the legal acts of the Republic of Lithuania.

The following principles are followed for the collecting of your personal data: personal data is collected for defined and legal purposes; personal data is processed accurately and fairly; personal data is updated on a regular basis; personal data is stored no longer than the established data processing purposes shall require; personal data is processed only by entitled employees; all information about processed personal data is confidential.

The Owner undertakes to ensure the protection of the processed data, to implement the appropriate technical and organizational measures to protect personal data from unauthorized disclosure and from any illegal processing, and to comply with the requirements of legal acts while processing your personal data.

The Mobile App user is responsible for the appropriate use of the Mobile App and for the correctness of the data provided. If the data provided is inaccurate, false or misleading, the Owner has the right to cancel your registration and delete the data or limit your possibility to use the Mobile App.

You are entitled to change and/or update the information provided in the registration form at any time by changing the data in the Mobile App.

3. The Owner's responsibility

The Owner is not responsible for any damage that you may incur as a result of using the Mobile App and accepts no liability for connection problems, malfunctioning of your operated equipment or other issues.

4. Procedure for payment for services

The payment for services can be charged by adding it to the monthly services invoice issued to the client by the mobile operator, also, by deducting it from the amounts for services paid in advance by the client to the mobile operator, or by deducting the amount for services from the payment card account specified by the client. Purchasing services via the Mobile App is an additional way to purchase services. If you cannot pay for services via the Mobile App due to insufficient balance in the account, connection problems or any other reasons, you have to choose another payment method that ensures proper payment for services in a particular case.

The Owner has the right to partially or completely change the terms of use of the Mobile App and inform about it in the Mobile App.
